INKIVE 이용약관

본 약관은 [회사명 TBD](이하 “회사”)가 제공하는 INKIVE의 타투 이미지 탐색, 저장, 컬렉션, 아티스트 정보 제공, AI 추천, 위치 기반 탐색 및 외부 문의 연결 서비스의 이용과 관련하여 회사와 회원 간의 권리, 의무 및 책임사항을 정하는 것을 목적으로 합니다.

INKIVE는 회원에게 다음과 같은 서비스를 제공합니다.

1. 타투 작품 이미지 탐색 서비스
2. 타투 스타일, 부위, 태그, 지역 기반 검색 서비스
3. 작품 저장 및 컬렉션 생성 서비스
4. 아티스트 포트폴리오 및 프로필 열람 서비스
5. 위치 기반 아티스트 및 콘텐츠 탐색 보조 서비스
6. 작품 및 컬렉션 공유 서비스
7. AI 기반 타투 스타일 추천 및 아티스트 매칭 보조 서비스
8. 외부 플랫폼(예: Instagram DM 등)으로 연결되는 문의 서비스
9. 기타 회사가 추가로 제공하는 서비스

회원은 회사가 정한 절차에 따라 이메일 또는 간편 로그인 방식으로 회원가입할 수 있습니다. 회원가입 시 회원은 정확한 정보를 제공해야 하며, 허위 정보 또는 타인의 정보를 이용하여 가입할 수 없습니다. 회사는 다음의 경우 회원가입을 거절하거나 제한할 수 있습니다.

• 타인의 정보를 도용한 경우
• 허위 정보를 입력한 경우
• 서비스 운영을 방해할 우려가 있는 경우
• 관련 법령 또는 본 약관을 위반한 이력이 있는 경우

회원은 본인의 계정 정보를 직접 관리할 책임이 있습니다. 회원의 부주의로 인해 계정이 도용되거나 제3자가 이용한 경우, 회사는 회사의 고의 또는 중대한 과실이 없는 한 책임을 지지 않습니다.

회원은 서비스를 이용하면서 다음 행위를 해서는 안 됩니다.

• 타인의 권리, 저작권, 초상권, 개인정보를 침해하는 행위
• 불법적이거나 부적절한 콘텐츠를 업로드하거나 공유하는 행위
• 혐오, 폭력, 차별, 음란, 불법 콘텐츠를 게시하는 행위
• 서비스의 정상적인 운영을 방해하는 행위
• 크롤링, 자동화 프로그램 등을 통해 서비스를 무단 수집하는 행위
• 회사 또는 제3자의 명예를 훼손하는 행위
• 허위 문의, 스팸, 광고성 행위
• 기타 관련 법령 또는 본 약관을 위반하는 행위

회사는 위반 행위가 확인될 경우 회원의 서비스 이용을 제한하거나 계정을 정지 또는 삭제할 수 있습니다.

INKIVE에 노출되는 타투 작품 이미지, 아티스트 정보, 태그, 설명 등은 회사가 직접 등록하거나 공개된 포트폴리오 정보를 기반으로 수집, 정리, 제공할 수 있습니다. 회원은 서비스 내 콘텐츠를 개인적인 참고 목적 외에 무단 복제, 배포, 판매, 재가공할 수 없습니다. 콘텐츠에 대한 저작권, 초상권, 권리 침해 문제가 있다고 판단되는 경우, 권리자는 회사에 신고 또는 삭제 요청을 할 수 있으며, 회사는 신고 내용을 검토한 후 필요 시 해당 콘텐츠를 비공개 또는 삭제 처리할 수 있습니다.

회원은 마음에 드는 타투 작품, 아티스트, 컬렉션을 저장할 수 있습니다. 회원이 생성한 컬렉션은 설정에 따라 비공개 또는 공개될 수 있으며, 공개 컬렉션은 다른 사용자에게 노출되거나 공유될 수 있습니다. 회원은 본인이 생성한 컬렉션의 제목, 설명, 구성 이미지에 대해 책임을 집니다.

INKIVE는 회원이 입력한 스타일, 부위, 지역, 예산, 참고 이미지 등의 정보를 바탕으로 타투 스타일 또는 아티스트 추천을 제공할 수 있습니다. AI 추천 결과는 참고용 정보이며, 실제 작업 가능 여부, 가격, 일정, 디자인 최종 결정은 아티스트 또는 스튜디오와의 상담을 통해 확정됩니다. 회사는 AI 추천 결과의 정확성, 완전성, 특정 아티스트와의 예약 성사 여부를 보장하지 않습니다.

INKIVE는 회원의 동의가 있는 경우 현재 위치, 설정 지역, IP 기반 대략 위치, 검색 지역 정보를 활용하여 주변 또는 선택 지역의 타투 아티스트, 콘텐츠, 추천 결과를 제공할 수 있습니다. 위치정보는 아티스트 탐색, 지역 기반 검색, AI 추천, 콘텐츠 추천 품질 개선을 위해 사용됩니다. 회원은 기기 설정 또는 서비스 설정을 통해 위치정보 제공을 제한하거나 철회할 수 있으며, 이 경우 위치 기반 추천의 정확도나 일부 기능이 제한될 수 있습니다.

INKIVE는 회원이 관심 있는 아티스트에게 문의할 수 있도록 Instagram DM 등 외부 플랫폼으로 연결되는 기능을 제공할 수 있습니다. 외부 플랫폼에서 이루어지는 상담, 예약, 결제, 작업 진행, 분쟁 등은 해당 회원과 아티스트 또는 외부 플랫폼 간의 책임으로 진행됩니다. 회사는 플랫폼 내에서 직접 예약, 결제, 계약을 중개하지 않는 MVP 단계에서는 외부 상담 결과에 대해 책임을 지지 않습니다. 단, 회사가 직접 운영하거나 제휴한 상담/예약 서비스가 도입되는 경우 별도의 정책 또는 약관이 적용될 수 있습니다.

회사는 서비스 개선, 운영상 필요, 기술적 문제, 정책 변경 등의 사유로 서비스의 일부 또는 전부를 변경하거나 중단할 수 있습니다. 중요한 변경이 있는 경우 회사는 서비스 내 공지 또는 이메일 등을 통해 회원에게 안내합니다.

회원은 언제든지 서비스 내 계정 삭제 기능 또는 고객센터를 통해 회원 탈퇴를 요청할 수 있습니다. 회원 탈퇴 시 회원의 계정 정보는 관련 법령 및 개인정보처리방침에 따라 삭제 또는 보관됩니다. 단, 법령상 보관이 필요한 정보, 부정 이용 방지 목적의 최소 정보, 이미 공개 또는 공유된 콘텐츠의 일부 정보는 일정 기간 보관될 수 있습니다.

회사는 다음의 경우 책임을 지지 않습니다.

• 회원이 입력한 정보의 오류로 발생한 문제
• 회원 간 또는 회원과 아티스트 간의 개별 거래, 상담, 예약 과정에서 발생한 문제
• 외부 플랫폼(예: Instagram, Google 등)에서 발생한 장애 또는 정책 변경
• 회원의 귀책 사유로 발생한 서비스 이용 장애
• 천재지변, 서버 장애, 해킹 등 회사가 합리적으로 통제하기 어려운 사유

회사는 필요한 경우 본 약관을 변경할 수 있습니다. 변경된 약관은 서비스 내 공지 또는 이메일을 통해 안내하며, 회원이 변경 후에도 서비스를 계속 이용하는 경우 변경 약관에 동의한 것으로 봅니다. 본 약관은 대한민국 법령에 따라 해석되며, 분쟁 발생 시 대한민국 서울중앙지방법원을 1심 관할법원으로 합니다.

These Terms of Service set forth the rights, obligations, and responsibilities between [Company TBD] (“we” or “the Company”) and members regarding the use of INKIVE’s services, including tattoo image discovery, saving, collections, artist information, AI recommendations, location-based discovery, and external inquiry connections.

INKIVE provides the following services to members.

1. Tattoo artwork image discovery
2. Search by tattoo style, body placement, tag, and region
3. Artwork saving and collection creation
4. Viewing artist portfolios and profiles
5. Location-based artist and content discovery support
6. Sharing artworks and collections
7. AI-assisted tattoo style recommendations and artist matching support
8. Inquiry connections to external platforms, such as Instagram DM
9. Other services provided by INKIVE

Members may sign up through email or social login methods designated by INKIVE. When signing up, members must provide accurate information and must not use false information or another person’s information. We may refuse or restrict membership in the following cases.

• The member uses another person’s information
• The member provides false information
• The member may interfere with the operation of the service
• The member has violated applicable laws or these Terms

Members are responsible for managing their own account information. We are not responsible for damages caused by unauthorized use of an account due to the member’s negligence, unless such damages are caused by our intentional misconduct or gross negligence.

Members must not engage in the following activities while using the service.

• Infringing on another person’s rights, copyright, portrait rights, or personal information
• Uploading or sharing illegal or inappropriate content
• Posting hateful, violent, discriminatory, obscene, or illegal content
• Interfering with the normal operation of the service
• Unauthorized collection of service data through crawling, bots, or automated tools
• Damaging the reputation of the Company or any third party
• Submitting false inquiries, spam, or advertising content
• Violating applicable laws or these Terms

If a violation is confirmed, we may restrict the member’s use of the service, suspend the account, or delete the account.

Tattoo artwork images, artist information, tags, descriptions, and other content displayed on INKIVE may be directly registered by us or collected, organized, and provided based on publicly available portfolio information. Members may not copy, distribute, sell, or modify service content without authorization, except for personal reference purposes. If a copyright, portrait right, or other rights infringement issue is identified, the rights holder may report or request removal of the content, and we may review such reports and, if necessary, hide or delete the relevant content.

Members may save tattoo artworks, artists, and collections they like. Collections created by members may be private or public depending on the member’s settings. Public collections may be displayed to other users or shared externally. Members are responsible for the titles, descriptions, and images included in the collections they create.

INKIVE may provide tattoo style or artist recommendations based on information entered by the member, such as style, body placement, region, budget, and reference images. AI recommendation results are provided for reference only. Actual availability, pricing, scheduling, design decisions, and final tattoo work must be confirmed through consultation with the artist or studio. We do not guarantee the accuracy, completeness, or successful booking of any specific artist based on AI recommendation results.

If a member consents, we may use current location, selected region, IP-based approximate location, and region-related search information to provide nearby or selected-region tattoo artists, content, and recommendation results. Location information is used to support artist discovery, region-based search, AI recommendations, and improved content recommendation quality. Members may restrict or withdraw location access through device settings or service settings. In that case, the accuracy or availability of location-based features may be limited.

INKIVE may provide features that allow members to contact artists through external platforms such as Instagram DM. Consultations, bookings, payments, tattoo sessions, disputes, and related matters that occur on external platforms are handled between the member and the artist or external platform. During the MVP stage, where INKIVE does not directly mediate bookings, payments, or contracts within the platform, we are not responsible for the outcome of external consultations. However, if we later introduce direct consultation, booking, or payment services operated by us or partner artists, separate policies or terms may apply.

We may change, suspend, or discontinue part or all of the service due to service improvements, operational needs, technical issues, or policy changes. In the event of significant changes, we will notify members through in-service notices, email, or other appropriate methods.

Members may request account deletion at any time through the account deletion feature within the service or through customer support. When a member deletes their account, account information will be deleted or retained in accordance with applicable laws and the Privacy Policy. However, certain information may be retained for a specified period if required by law, necessary to prevent misuse, required for dispute handling, or already included in public or shared content.

We are not responsible for the following.

• Problems caused by incorrect information entered by the member
• Issues arising from individual transactions, consultations, or bookings between members and artists
• Failures or policy changes on external platforms, such as Instagram or Google
• Service disruptions caused by the member’s own fault
• Events beyond our reasonable control, such as natural disasters, server failures, or hacking

We may change these Terms when necessary. Changed Terms will be announced through the service, email, or other appropriate methods. If a member continues to use the service after the changes take effect, the member will be deemed to have agreed to the changed Terms. These Terms are governed by the laws of the Republic of Korea, with exclusive first-instance jurisdiction in the Seoul Central District Court, Republic of Korea.
